Debt Resolution/Forensic Mitigation. This is where a third party acts on your behalf to negotiate with each of your creditors one at a time to reduce the amount of your debt. The process involves you putting aside a certain amount of money each month. Out of the money you put aside each month a certain amount goes toward paying your fees and the rest goes into a savings account. Once your savings reaches a certain level a third party begins negotiating with one of your creditors. Once the third party agrees to a settlement the savings you have accumulated are used to pay the settlement.
After the first creditor is paid the process is repeated sequentially until all of your enrolled debts are settled. In order to participate in a program like this you must have a genuine financial hardship, otherwise a creditor could claim you are attempting to get out of the debt them and that you never had any intention of repaying them. There are two types of debt resolution programs.
First is legally supervised, where a licensed attorney in your state provides and supervises the debt resolution/forensic mitigation services. There are also traditional programs where a law firm is not involved.
We believe that the use of lawyers is a superior approach because you have an advocate working exclusively for you who is not receiving any payment from the creditors. The length of these programs depends on the amount of debt you enroll and range from 16 months (just over a year) to 48 months maximum. Your secured assets such as your home and car are not affected at all and you do not have to get involved with a bankruptcy trustee.
The greatest benefit of programs like these is that not only do the get you out of debt in a reasonable amount of time they usually offer a significant payment reduction on your debts each month even including the fees for the program.
